The Intellectual Property Office of Vietnam (IPVN) has just notified of the program, which is currently in Phase 3, spanning three years (2022-2025); each year is divided into two stages, with a quota of 100 PPH requests per stage.
According to the announcement, during the first stage of the third year of Phase 3 (from 1 April 2024 to 30 September 2024), only 45 PPH requests were filed. This represents a decrease of 10 requests compared to the second stage of the second year (1 October 2023 to 31 March 2024). This drop continues the downward trend in the number of PPH requests, as mentioned in our previous report (see here).
The decline in PPH requests can be attributed to the fact that patent prosecutions in Vietnam were often delayed in the past, which heightened the importance of PPH requests to expedite the process. However, with recent improvements in the processing speed at the IPVN, the need for PPH requests has lessened as trended above.
Consequently, the quota for PPH requests in the second stage of the third year (1 October 2024 to 31 March 2025) is 155 requests, with the remaining 55 requests of the first stage being carried over to the next stage.
